Horrible association....I should know I live here. I am currently having a problem with a neighbor smoking in her garage on the property. She has the ability to smoke in her home or backyard but instead walks across the common area to her garage which is located under our unit to light up. In our CC&R's and Rules and Regulations it states:

2. No noxious or offensive activity shall be carried on in any Unit, Garage or in the Common Area, nor shall anything be done which may be or become an annoyance or nuisance to the other residents. Nuisance may include, for example, a visual blight, loud music, noxious, odorous, destructive or offensive activity or anything which causes significant disturbance or annoyance to others.

We complained to the association and property manager which stated, it was not their problem. This is the property managers response:

Thank you for contacting our office, we understands and sympathizes with your situation, but, there are no restriction for homeowners smoking in their private garages. Smoking anywhere outside the privacy of their home can be subject to a citation. This includes public places even if they are privately owned, such as a parking lot. This is currently not an HOA matter. The homeowner would have to be smoking outside in the common area for it to become an HOA matter. Should the violation occur in the common area of the HOA, please let us know. Please know, in efforts to help alleviate the issue, we will reach out to the homeowner to make them aware of the issue.

Well Kacie from Compass Property Management Group's response makes absolutely no sense whatsoever and went as far as telling the smoker it was OK to smoke in her garage if you can believe that.

Today I had to go to the hospital because of a severe asthma attack because of the cigarette smoke and was diagnosed with "extrinsic asthma exacerbation triggered by secondhand cigarette smoke". I was perscribed albuterol HFA for secondhand smoke exposure and was advised to avoid secondhand smoke which currently is impossible.

My next move will be to contact an attorney to force the HOA to enforce the existing Rules and Regulations and CC&R's.

This is the worst HOA I have ever.
